Detailed_Description : The Ministry-s mandate to enforce support orders includes the authority to commence court-based enforcement including Notices of Default Hearing and Motions for Warrant of Committal. Certain types of legal proceedings require a party to be served personally with legal documents. Rule 6(4) of the Family Law Rules requires “special service” as set out in the Rules if a person faces the possibility of imprisonment. The Ministry must serve documents in the same manner as any other party to litigation.
Scope of Work : The Ministry uses process servers to serve legal documents where personal service is required. Process servers are generally used to serve support payors with Notices of Default Hearings and Motions for Warrant of Committal. Using the Ministry-s secure email service, the Ministry electronically sends documents to the process server for service in the geographical area where the payor resides. For each assignment, a letter is included with the instructions the Ministry expects the process server to follow. The Ministry may contact the process server by phone or by e-mail for urgent or time sensitive matters. Upon successful service of documents, the process server is required to complete an Affidavit of Service. Upon unsuccessful service, the process server must complete an affidavit of attempted service or a memorandum of non-service where applicable and send to the Ministry.
